At Flexee we respect your privacy. The privacy of your data is extremely important to us. Therefore, we handle your personal data responsibly, and we want you to be familiar with how we collect, use, and disclose your data. 

We collect your personal data in the following ways: 

  • Via our websites and apps/applications on any device (desktop, tablet or mobile or whatever the next big thing is), from which you are accessing this Privacy Policy 
  • From social media pages and apps that link to this Privacy Policy 
  • From email messages that we send to you that link to this Privacy Policy 
  • Offline interactions you have with us 

In this Privacy Policy, we refer to our Websites, our Apps, our Social Media Pages, our email messages, our offline activities and our services collectively as the “Services”. 

“Personal Data” is data that identifies you as an individual or relates to an identifiable individual. Funny fact: there are no laws today that protect your pet’s personal data. 

Personal data includes: 

  • Name (first, second or even 3rd) 
  • Email address 
  • Social media accounts ID 
  • Address (including billing and shipping addresses) 
  • Telephone number or mobile number 
  • Credit and debit card number
  • Profile picture
  • Other information such as age
  • Your Interests (such as topics about which you request data or otherwise indicate interest) 
  • Whatever Google says personal data is, also applies.

How do we gather & use your Personal Data 

When you contact us via website form, we ask for your name, where you work, email address and location. That’s just so we can create a record for you, and we can send you updates, other essential information. We’ll never sell your personal info to third parties. We won’t use your name or company in marketing statements to brag about ourselves without your permission, either.

When you write to us with a question or to ask for help, we’ll keep that correspondence, and the email address, for future reference. When you browse our marketing pages, we’ll track that for statistical and analytical purposes (like conversion rates and to test new designs). We also store any information you volunteer, like surveys, for as long as it makes sense. 

You may have heard about the General Data Protection Regulation (“GDPR”) in Europe. GDPR gives people under its protection certain rights with respect to their personal information collected by us on the Site. Accordingly, Flexee recognizes and will comply with GDPR and those rights, except as limited by applicable law. 

The rights under GDPR include: 

  • Right of Access. This includes your right to access the personal information we gather about you, and your right to obtain information about the sharing, storage, security and processing of that information. 
  • Right to Correction. This is your right to request correction of your personal information. 
  • Right to Erasure. This is your right to request, subject to certain limitations under applicable law, that your personal information be erased from our possession (also known as the “Right to be forgotten”). However, if applicable law requires us to comply with your request to delete your information, fulfillment of your request may prevent you from using our services and may result in closing your account. 
  • Right to Complain. You have the right to make a complaint regarding our handling of your personal information with the appropriate supervisory authority. 
  • Right to Restrict Processing. This is your right to request restriction of how and why your personal information is used or processed. 
  • Right to Object. This is your right, in certain situations, to object to how or why your personal information is processed. 
  • Right to Portability. This is your right to receive the personal information we have about you and the right to transmit it to another party. 
  • Right to not be subject to Automated Decision-Making. This is your right to object and prevent any decision that could have a legal, or similarly significant, effect on you from being made solely based on automated processes. This right is limited, however, if the decision is necessary for performance of any contract between you and us, is allowed by applicable European law, or is based on your explicit consent. 
  • Right to be happy, inspired, safe & fulfilled as a veterinary professional (whether you practice medicine or not). While this is not a GDPR right, this is part of our philosophy and what we do, so do reach out on this one, if needed.

Collection of Personal Data

We and our service providers collect Personal Data in a variety of ways, including: 

Through the Services we collect Personal Data, for example, when you sign up for a newsletter or opt in to receive updates. 

Offline, we collect Personal Data from you, for example: 

  • When you visit our booth or we meet elsehow at a tradeshow or visit each other; 
  • When you participate in our programs or activities or provide data at industry events.

We receive your Personal Data from other sources, for example: 

  • Publicly available databases and sources; 
  • Data companies; 
  • Joint marketing partners. 

If you connect your social media account to any account offered by us, you will share certain Personal Data from your social media account with us, such as your name, email address, photos, list of social media contacts, and any other data that may be (or that you make) accessible to us when you connect your social media account to any account offered by us. 

In many instances, we need to collect Personal Data in order to provide the requested Services to you. If you do not provide the Personal Data requested, we may not be able to provide the Services. If you disclose any Personal Data relating to other people to us or to our service providers in connection with the Services, you represent that you have the authority to do so and to permit us to use the Personal Data in accordance with this Privacy Policy. 

Use of Personal Data 

We and our service providers use Personal Data for legitimate business purposes when we interact with our customers including: 

  • Providing the Services and fulfilling your requests. 
  • To respond to your inquiries and fulfill your requests, when you contact us via one of our online contact forms, by email or otherwise, for example, when you send us questions, suggestions, compliments, or complaints. 
  • To send administrative information to you, such as changes to our terms, conditions, and policies. 
  • To facilitate social sharing functionality, if you choose to use such functionality. 
  • To provide you with customer service. 
  • Providing you with information about our products and/or services. 
  • To send you marketing related emails, with information about our services, products, and other news about us. 
  • Analysis of Personal Data for business reporting and providing personalized services. 
  • To analyze or predict your preferences in order to prepare aggregated trend reports on how our digital content is used. 
  • To better understand you, so that we can personalize our interactions with you and provide you with information tailored to your interests.

  • To comply with anti-corruption and transparency obligations. 

We engage in these activities to manage our relationship with you, to comply with a legal obligation, in some circumstances when we have your consent and/or because we have a legitimate business interest. 

Disclosure of Personal Data 

We may disclose Personal Data: 

  • To our third party service providers, to facilitate services they provide to us (we will ask for permission to do so). These can include providers of services such as website hosting, data analysis, payment processing, order fulfilment, information technology and related infrastructure provision, customer service, email delivery, auditing, and other services. 
  • In connection with providing our Professional Services, to other companies with which we collaborate regarding particular services. These can include our co-promotion partners for products that we jointly develop and/or market. 

By using the Services, you may also elect to disclose Personal Data. You may disclose Personal Data on message boards, chat, profile pages, blogs, and other services to which you are able to post data and content (including, without limitation, our Social Media Pages). Please note that any Personal Data you post or disclose through these services will become public and may be available to other users and the general public. You may also disclose Personal Data through your social sharing activity. When you connect your Services account with your social media account, you may share data with other users associated with your social media account, and with your social media account provider. By doing so, you authorize us to facilitate this sharing of data, and you understand that the use of shared data will be governed by the social media provider’s privacy policy. 

Other Uses and Disclosures

We also use and disclose your Personal Data as necessary or appropriate: 

  • To comply with applicable laws and regulations. 
  • To cooperate with public and government authorities. 
  • To cooperate with law enforcement. 
  • In connection with a sale, reorganization, joint venture or other business transaction, where we have a legitimate interest in disclosing or transferring your Personal Data to a third party. 
  • For other legal reasons, such as enforcing our terms and conditions or protecting our rights, privacy, safety, or property, and/or that of our subsidiaries or affiliates, you, or others. 

These uses and disclosures of your personal data can occur outside your country of residence. 

OTHER DATA 

“Other Data” is any data that does not reveal your specific identity or does not directly relate to an identifiable individual: 

  • Browser and device data 
  • App usage data 
  • Data collected through cookies, pixel tags, and other technologies 
  • Demographic and other data provided by you that does not reveal your specific identity 
  • Data that has been aggregated in a manner such that it no longer reveals your specific identity 

Some Other Data will be considered Personal Data in some countries. If we are required to treat Other Data as Personal Data under applicable law, then we will use and disclose it for the purposes for which we use and disclose Personal Data, as detailed in this Privacy Policy. 

Collection of Other Data 

We and our service providers may collect Other Data in a variety of ways, including: 

  • Through your browser or device 
  • Certain data is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Mac), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version, and the name and version of the Services (such as the App) you are using. 
  • Through your use of an App 
  • When you download and use an App, we and our service providers may track and collect App usage data, such as the date and time the App on your device accesses our servers and what data and files have been downloaded to the App based on your device number. 

Using cookies Cookies are pieces of data stored directly on the computer that you are using. Cookies allow us to collect data such as browser type, time spent on the Services, pages visited, referring websites, and other traffic data. For more information about cookies, please see our Cookies Policy. We do not currently respond to browser do-not-track signals. If you do not want data collected through the use of cookies, most browsers allow you to automatically decline cookies or be given the choice of declining or accepting a particular cookie (or cookies) from a particular website. You may also wish to refer to http://www.allaboutcookies.org. If, however, you do not accept cookies, you may experience some inconvenience in your use of the Services. You also may not receive advertising or other offers from us that are relevant to your interests and needs. 

Using pixel tags, and other similar technologies Pixel tags (also known as web beacons and clear GIFs) may be used to, among other things, track the actions of users of the Services (including email recipients), measure the performance of our marketing campaigns, and compile statistics about usage of the Services and response rates. 

Analytics We use Google Analytics which uses cookies and similar technologies to collect and analyze data about the use of the Services and report on activities and trends. This service may also collect data regarding the use of other websites, apps, and online resources. You can learn about Google’s practices by going to google.com/policies/privacy/partners/, and opt out of them by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout. Using Adobe Flash technology (including Flash Local Shared Objects (“Flash LSOs”)) and other similar technologies We may use Flash LSOs and other technologies to, among other things, collect and store data about your use of the Services. If you do not want Flash LSOs stored on your computer, you can adjust the settings of your Flash player to block Flash LSO storage using the tools contained in the Website Storage Settings Panel. You can also go to the Global Storage Settings Panel and follow the instructions. Please note that setting the Flash Player to restrict or limit acceptance of Flash LSOs may reduce or impede the functionality of some Flash applications. 

IP Address Your IP address is automatically assigned to your computer by your Internet Service Provider. An IP address may be identified and logged automatically in our server log files whenever a user accesses the Services, along with the time of the visit and the page(s) visited. Collecting IP addresses is standard practice and is done automatically by many websites, applications, and other services. We use IP addresses for purposes such as calculating usage levels, diagnosing server problems, and administering the Services. We may also derive your approximate location from your IP address. 

Physical Location We may collect the physical location of your device by, for example, using satellite, cell phone tower, or Wi-Fi signals. We may use your device’s physical location to provide you with personalised location-based services and content. In some instances, you may be permitted to allow or deny such uses of your device’s location, but if you do, we may not be able to provide you with the applicable personalised services and content. 

Uses and Disclosures of Other Data 

We may use and disclose Other Data for any purpose, except where we are required to do otherwise under applicable law. In some instances, we may combine Other Data with Personal Data. If we do, we will treat the combined data as Personal Data as long as it is combined. 

SECURITY 

We seek to use reasonable organizational, technical, and administrative measures to protect Personal Data within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us by contacting Consumer Affairs. 

CHOICES AND ACCESS 

Flexee recognizes and will comply with GDPR and those rights, except as limited by applicable law, as detailed at the top of this document.

Your choices regarding our use and disclosure of your Personal Data 

We give you choices regarding our use and disclosure of your Personal Data for marketing purposes. 

You may opt-out anytime from receiving electronic communications from us. If you no longer want to receive marketing-related emails, texts or SMS messages from us, you may opt-out by contacting us via e-mail (hello@myflexee.com). We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related communications from us, we may still send you important administrative messages, from which you cannot opt-out. 

How you can access, change, or delete your Personal Data 

If you would like to review, correct, update, suppress, restrict, or delete Personal Data that you have previously provided to us, object to the processing of your data, or if you would like to request to receive an electronic copy of your Personal Data for purposes of transmitting it to another company (to the extent this right to data portability is provided to you by applicable law), you may contact us by email. We will respond to your request consistent with applicable law.

For your protection, we may only implement requests with respect to the Personal Data associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable. 

Please note that we may need to retain certain data for record keeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion (e.g., when you make a purchase or enter a promotion, you may not be able to change or delete the Personal Data provided until after the completion of such purchase or promotion), or to be able to honor opt-out requests. 

RETENTION PERIOD 

We retain Personal Data for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law and Company policy. 

THIRD PARTY SERVICES 

This Privacy Policy does not address, and we are not responsible for the privacy, data, or other practices of any third parties, including any third party operating any website or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our subsidiaries or affiliates. 

In addition, we are not responsible for the data collection, use, disclosure, or security policies or practices of other organizations or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider, or device manufacturer, including with respect to any Personal Data you disclose to other organizations through or in connection with the Apps or our Social Media Pages. 

OUR ADVERTISING 

We use third-party advertising companies to serve advertisements regarding goods and services that may be of interest to you when you access and use the Services and other websites or online services. 

Such advertisements are served based on your access to and use of our Services and other websites or online services on any of your devices, as well as on data received from third parties. Third-party advertising companies make this possible by placing or recognizing a unique cookie on your browser (including through the use of pixel tags). They also use these technologies, along with data they collect about your online use, to recognize you across the devices you use, such as a mobile phone and a laptop. MINORS 

Unless otherwise indicated, the Services are not directed to minors as defined by applicable law. For example, in the US, minors are individuals under the age of 13, and in the EEA, we honor Member State laws, and we do not knowingly collect Personal Data from minors. If you provide us with Personal Data of minors, you represent that you have the appropriate authority to do so and that you can demonstrate such authority to us upon request. 

JURISDICTION AND CROSS-BORDER TRANSFER 

Your Personal Data may be stored and processed in any country where we have facilities or in which we engage service providers, and, by using the Services, you understand that your Personal Data will be transferred to countries outside of your country of residence, to business which may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies, or security authorities in those other countries may be entitled to access your Personal Data. 

Some of the non-EEA countries are recognized by the European Commission as providing an adequate level of data protection according to EEA standards (the full list of these countries is available here. For transfers from the EEA to countries not considered adequate by the European Commission, we have put in place adequate measures, such as standard contractual clauses adopted by the European Commission, to protect your Personal Data. You may obtain a copy of these measures by sending an e-mail request. 

SENSITIVE PERSONAL DATA 

Unless we specifically request it, we ask that you not send us, and you not disclose any sensitive Personal Data (e.g., social security numbers, data related to racial or ethnic origin, political opinions, religion or other beliefs, biometrics or genetic characteristics, criminal background, or trade union membership) on or through the Services or otherwise to us. 

THIRD-PARTY PAYMENT SERVICE 

We may use a third-party payment service to process payments made through the Services. If you wish to make a payment through the Services, your Personal Data will be collected by such third party and not by us, and will be subject to the third party’s privacy policy, rather than this Privacy Policy. We have no control over, and are not responsible for, this third party’s collection, use and disclosure of your Personal Data. 

UPDATES TO THIS PRIVACY POLICY 

The “LAST UPDATED” legend at the top of this Privacy Policy indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy on the Services. Your use of the Services following these changes means that you accept the revised Privacy Policy. Terms of Service

Introduction

By using Flexee Ltd (“Services”), a company registered in England and Wales with company number 13193538 whose registered office is at Marland House, 13 Huddersfield Road, Barnsley, South Yorkshire, S70 2LW, you are agreeing to be bound by the following terms and conditions (“Terms of Service”).

Flexee Ltd has the right to make changes to these Terms of Service, which are necessary to comply with any relevant regulations and law without. We shall notify you in any such event by email.

Commencement of term 

This agreement commences on the date of commencement and remains effective for 12 months after which it will automatically renew on a 12 monthly basis.

You must provide your legal full name and a valid email address, and some other information requested in order to complete the Agreement process.

You may enjoy the content available to you via our website & social media services as long as you agree to our Privacy Policy.

Use and provision of services 

Your use of the Service is at your sole risk. The service is provided on an “as is” and “as available” basis. It is your responsibility to ensure that the Services of Flexee Ltd are suitable for your business, including upgrading and maintenance of your web browser software.

Flexee Ltd shall provide Services using reasonable skill and care. Flexee Ltd does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.

Flexee Ltd shall make changes to these Services, which are necessary to comply with any relevant regulations and law without. We shall notify you in any such event by email.

You understand that Flexee Ltd uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service. 

You acknowledge that the Intellectual Property rights of the Services of Flexee Ltd and the Flexee logo, Flexee Health Score badge and brand materials are the sole property of Flexee Ltd.

You shall be able to display the Flexee Health Score badge on your website, marketing materials and social media channels where it can be seen by visitors. The use of the badge is non-exclusive, non-transferable and revocable for the Term of this Agreement. You must make reasonable efforts to use the Flexee Health Score badge in a professional manner at all times.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Flexee Ltd.

We use reasonable measures to ensure that the website is safe. You understand that the technical processing and transmission of the Service, including your content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.

Contact emails

Customer data

By engaging with the Services or Flexee Ltd, you and your practice are “Customers”. You are responsible for providing us with the customer data and you acknowledge that our Services depend on the provision of this data to us by you.

You warrant that the customer data provided is true, accurate and complete, and has not been selectively chosen or edited by you to manipulate the results of your Flexee Health Score, and in accordance with this Agreement, that the use of this customer data will not be in breach of Data Privacy Laws, or in breach of the Intellectual Property Rights of a third party, or in breach of any applicable law.

For the Term, you grant Flexee Ltd a royalty-free, non-exclusive, non-transferable, irrevocable ability to use your Intellectual Property Rights in your practice name and logo for the purposes of the Flexee Health Score database and the purpose of promoting the Services by means of reference on the Flexee website, in our public statements and materials to the fact that you are participating in the Flexee Health Score. In doing so we use reasonable efforts not to do anything that damages your brand.

Modifications to the service and prices 

Flexee Ltd reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, any part of the Service.

Prices of all Services are subject to change upon 30 days notice from us. Such notice may be provided at any time by email. 

Flexee Ltd shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service. 

Copyright and content ownership 

We claim no intellectual property rights over the material you provide to the Service. All materials you provide remain yours. 

The look and feel of the Service is Flexee Ltd. All rights reserved. You may not duplicate, copy, or reuse any portion of the service without express written permission from Flexee Ltd. 

Payment and refunds

Some services are free of charge to allow us to live our mission (for example, we may offer some free blogs, podcasts, webinars and email newsletters).

For subscribing companies, Flexee Ltd will invoice you for Services on a monthly basis. For the avoidance of doubt, Service fees are payable regardless of whether you have provided customer data or used the Services during the respective month. 

Amounts payable by you are exclusive of value added tax (VAT) and shall be paid in full.

Flexee Ltd reserves the right to charge a 10% late payment fee upon failure to pay any amount due within 14 days of the payment date.

Suspension and termination

You are solely responsible for properly cancelling your contract. Either party may terminate this Agreement by providing the other party 30 days written notice via email, which takes effect from the next invoicing date. Flexee Ltd, in its sole discretion, has the right to suspend or terminate your contract and refuse any and all current or future use of the Service for any reason at any time.

On termination of the Agreement, both parties shall fulfil to the other all due payments in accordance with this Agreement by paying all outstanding invoices relating to the Service supplied.

On termination of the Agreement, we shall remove all your name, logo and feedback from the Flexee website and social media. For the avoidance of doubt, you may not require Flexee Ltd to delete your details where we are legally required to retain it.

On termination of the Agreement, you shall remove all Flexee Ltd’s name, logo and feedback from your website. For the avoidance of doubt, we may not require Flexee Ltd to be deleted where you are legally required to retain it.

Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Service, customer or team member will result in immediate contract termination.

Feedback, marketing and promotion

You agree that Flexee Ltd may publish feedback which you provide on the Services on the Flexee website and social media channels for the period of the Agreement for marketing and promotion purposes, ensuring that the information published is genuine and accurate.

You may publish feedback which Flexee Ltd provides on your customer data on your practice website and social media channels for the period of the Agreement for marketing and promotion purposes, ensuring that the information published is genuine and accurate.

Data protection

The parties shall comply with Data Protection Laws applicable to it in relation to this Agreement.

Flexee Ltd acts as Processor with respect to customer emails, and Controller with respect to feedback. The subject matter of processing is emails. The duration of processing is the Term.  The data subject is the named person in this Agreement. The nature and purpose of this processing is collecting market data for the purposes of product development and quality monitoring. The types of personal data involved are names and email addresses.

Where Flexee Ltd acts as Processor of Customer Data we will act only as set out in this Agreement or on written instructions by you. Flexee Ltd will take reasonable measures against unauthorised or unlawful processing of customer data, or accidental loss or damage to customer data. Flexee Ltd will process customer data only as necessary for the purposes of this Agreement. Flexee Ltd will take reasonable measures to ensure that its staff are under confidentiality obligations in relation to customer data. Flexee Ltd will not engage a subcontractor to process customer data unless we have notified you of such intent, no less than 30 days before appointment of a subcontractor, and you have not objected to such appointment within 14 days of such notice.

Both parties will provide reasonable help and cooperation as necessary to comply with data protection.

Limitation of liability

You expressly understand and agree that Flexee Ltd shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Flexee Ltd has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service. The failure of Flexee Ltd to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Flexee Ltd, and govern your use of the Service, superseding any prior agreements between you and Flexee Ltd (including, but not limited to, any prior versions of the Terms of Service).

This Agreement does not limit or exclude either party from any liability that may not be excluded under British law.

Confidentiality

Both parties will keep each other’s confidential information confidential and may not disclose confidential information in whole or part to a third party, except with prior written consent of the other party.

Either party may disclose confidential information as required by legal or regulatory authorities.

Notices

Any notice or communication given to a party in connection with this Agreement shall be in writing by email.

General

This Agreement constitutes the entire agreement between the parties. It supersedes and nullifies all previous agreements or representations, either written or oral, relating to this subject matter.

No amendment may be made to this Agreement unless made in writing and signed by both parties.

Definitions

Confidential Information” means all confidential or commercially sensitive information disclosed on or after the date of commencement of the Agreement;

Customers” means you and your practice as a customer of Flexee Ltd whom you have requested that we contact in order to provide the Services;

Customer Data” means the data provided by you to us relating to your practice or practices, which shall include the practice name, email address, contact telephone number and the answers to the questions in the Flexee Health Score;

Feedback” means the feedback provided to us by you relating to your business (including any other data provided in your answers to the Flexee Health Score) and, where relevant, your response;

Intellectual Property Rights” means rights in inventions, patents, copyright and related rights, rights in designs, rights in databases, rights in confidential information (including know-how and trade secrets) and rights in trade marks, service marks, trade, business and domain names, whether registered or unregistered and all similar or equivalent rights or forms of protection in any part of the world;

Services” means use of the the Flexee Ltd name and logo, materials and education services provided to you by us in accordance with the terms of this Agreement;

Term” means the commencement date, the duration and any continuation of this Agreement.
